What does Tenudi want the University to actually do?

As a public university, isn’t the university legally not allowed to punish students for the things they say in private due to the first amendment? If so, what can we actually expect the school to do about that Aphi? I’m no lawyer so i could be wrong on how that works but I was under the impression that that’s how it works

only 2 girls in aphi filed reports and they both dropped the charges against her
